Navigating Special Education Laws

Under the Individuals with Disabilities Education Improvement Act (IDEA), children with disabilities are entitled to special individual rights not available to the general student population. Also, Section 504 of the Rehabilitation Act of 1973 (Section 504) provides a set of rights to address the issues of those children not classified under IDEA. Rights included under the law include:
- Testing, assessments to determine eligibility for special services, and in some cases, district-funded independent evaluations
- Access to your child’s student records
- The right to district-funded private and/or residential placement
- The right to attend school outside of your district at the expense of your local school district
- Access to dispute resolution with the school through a defined administrative and legal process
- Working directly with local school district personnel to develop a written Individualized Education Program (IEP) or Section 504 plan for the student
- Special services such as 1-on-1 instruction, 1-on-1 aide, occupational, physical and speech therapy
- The right to district-funded private and/or residential placement
- The right to accommodations in any district or institution that receives tax dollars
